A clarification on the legal-cannabis industrial use.
The law on CBD cannabis is still unclear, and today many people are wondering what does “industrial and technical cannabis” means. Before explaining it, it is a good idea to do a little explaation, to understand better the issues that define the production and trade of legal marijuana.
First of all, you should know that in reality, the cultivation of industrial hemp has never been legally prohibited. Still, its persecution was born out of a misinterpretation of the old law in this regard. Finally, in 1997, a Communication on Agricultural and Forestry Policies reopened the way for the cannabis production chain.
In 2002, circular no. 1 completes the document mentioned above on the rules of cultivation of industrial hemp by setting the maximum THC rate at 0.2% . Since this limit was set, we can therefore speak of CBD weed, characterised by the high level of CBD, the non-psychotropic cannabinoid of cannabis.
The Italian decree. 242 of 2016 (country of origin of Just Bob), signed by the then President Mattarella, is still in force. In this text, the authorised uses of industrial hemp have been established, but there is no mention of marijuana inflorescences, leaving the door open to their commercialisation.
Let’s now look at what happened after the Decree-Law came into force on 14 January 2017.
Legal hemp: law 242 of 2016 and birth of industrial use
The law on cannabis to which we still refer today is Decree 242 of 2016, which specified the authorised uses of hemp as follows :
- Food and cosmetics
- Semi-finished products such as fibres, sheaves, powders, wood shavings, oils or fuels, intended for industries and craft activities
- Equipment for green manure practice
- Organic material for bio-engineering works or products useful for ecological construction
- Equipment for phytoremediation for the rehabilitation of polluted sites
- Cultures dedicated to teaching and demonstration activities as well as research by public or private institutes
- Crops for horticulture
As you can see, there is no reference to marijuana plants and their marketing. The reason was that if they were not prohibited, their production and sale were not banned.
Thus, was born the phenomenon of “CBD cannabis“, from a legal “hole” that is still in force. In any case, CBD buds (THC <0.2%), are specifically for “industrial use”: the meaning of this term is precisely the opposite of “human use”.

Is it legal to grow legal hemp at home?
The answer is yes, growing CBD cannabis outdoors or indoors at home is not a crime, and there are two main reasons for this:
- The seeds do not contain THC
- Hemp plants will (theoretically) produce flowers with THC within the legal limit.
However, the THC content of CBD flowers can vary for technical reasons, due to the genetic variability of a given batch of seeds. According to what the law says, this would lead to a possible hemp plants seizure, not to the indictment of the producer.
