It seems like a contradiction, but the same nation that experienced the Marijuana Tax Act of 1937 is now one of the the world’s leading producers of hemp, with a market worth over $4 billion.
The liberalization of hemp in many American states has allowed the development of a thriving industry that seems to know no crisis, even during the Covid-19 pandemic. During the health emergency, in fact, CBD consumers turned to the online market to compensate for the impossibility of buying in physical stores.
And it looks like this situation is only going to get better in the years to come!
According to an article published in Forbes, investment growth is estimated at 37% per year. If this turns out to be correct, it would mean that the CBD market could reach $19.5 billion within the next 4 years!
The accuracy of this prediction, however, depends on the FDA. In the next year it will have to decide whether to allow CBD to be marketed as an additive. Should this occur, we can expect a real boom of investment in the production and trade of cannabidiol products, not only with respect to food and drinks, but also with respect to medical products.

CBD and health: this is what science says
Due to its high content in cannabinoids, mainly THC (tetrahydrocannabinol) and CBD (cannabidiol), cannabis produces on our body a whole series of effects which can be used also for therapeutic purposes.
The most sought after effects are the reduction of stress and anxiety, the regulation of mood, and the promotion of sleep. However, there is often talk of using CBD as a real pharmaceutical.
Some research seems to show that it has health benefits and its therapeutic value has also been recognized by the World Health Organization, which approved its inclusion in medicines in 2019.

It is good to clarify that its use for therapeutic purposes must be done according to certain rules. In order to achieve the desired pharmacological effects without unnecessarily endangering the health, cannabis must be prepared by carefully dosing its active ingredients (CBD and THC).
Moreover, the cultivation of the plants must be done following the best quality standards, without using pesticides or other substances that would be harmful at the moment of intake.

CBD, legal or not?
The main substances contained in cannabis are THC and CBD. They are both cannabinoids but for the law they are very different.
THC is a molecule that has narcotic effects, and for this reason it is considered a drug, while CBD has no psychoactive effect. This is the reason for the difference between the marijuana plant (which contains high percentages of THC) and the hemp plant (which contains a minimal amount).
Therein lies the point of the 2018 Farm Bill, which allows industrial hemp to be grown when its THC content does not exceed 0.3%.
However, this does not mean that CBD is legal. Federal law doesn’t say anything specific about it, and the ultimate decision is up to the individual states. Therefore, to talk about the legality of CBD, one must consider state by state.
In general, where marijuana is legal (like in California), so is cannabidiol, whether for medical or recreational uses.
As for all others, however, analyzing each state’s individual laws would be too lengthy. Just know that, as a general rule, it is legal to sell and consume FDA-approved CBD products with exceptions that vary by state.
